Who needs a
consortium program?

Federal regulations under 49 CFR Part 382 require all employers with CDL drivers operating in interstate commerce to maintain a DOT-compliant random testing program.

Who Must Enroll

Any employer with one or more CDL-holding employees who operate commercial motor vehicles (CMVs) in interstate commerce is subject to FMCSA drug and alcohol testing rules. Small fleets that cannot meet minimum testing rates alone must join a consortium.

Annual Testing Minimums

Federal Random Testing Rates

Current minimum annual testing rates set by FMCSA under 49 CFR Part 382.305. Our program ensures your fleet meets or exceeds these requirements.

Why join a consortium? Small fleets (often fewer than 10 drivers) cannot statistically meet the random minimum rates on their own. Pooling with other employers in our consortium ensures compliance year-round.

What Is It

The FMCSA Drug & Alcohol Clearinghouse

The Clearinghouse is a federal database that records CDL drivers' drug and alcohol violations — positive tests, refusals, return-to-duty activity, and follow-up results. Employers are required to query it before a driver operates under their authority, and annually after that.

Owner-Operators

Can I Do the Query Myself?

Yes. If you hold your own DOT authority, you can register at clearinghouse.fmcsa.dot.gov as both employer and driver, give yourself consent, and run the required queries on your own record. There is no rule that says you must use a C/TPA for this step.
